Information about product safety (ProdSG) for promotional items

The Product Safety Act (ProdSG) requires a manufacturer's label for all products and thus also for promotional items.

The Product Safety Act (ProdSG) requires a manufacturer's label for all products and thus also for promotional items. In accordance with legal requirements, the marking must include the name and contact address of the manufacturer of the consumer product. The consumer product must also be labelled in such a way that it can be clearly identified.

The labeling of our products according to ProdSG is carried out as standard with the address of Kandinsky Deutschland GmbH. Individual labeling is possible at any time at the customer's request.

New product safety law - more concrete guidelines, stricter sanctions

On 1.12.2011 the legal basis for the distribution of promotional items has changed: The new Product Safety Act (ProdSG) has replaced the Equipment and Product Safety Act (GPSG) and brings with it new requirements for the marketing of consumer products and harsh sanctions.

Particularly important for the promotional items:

In addition to a clear identification mark, consumer products must also bear the name and contact address of the manufacturer or importer if the manufacturer is not established in the European Economic Area. This is a deliverable address with street, house number, postal code and city. In the context of identification marking, however, a designation of the product at the discretion of the manufacturer is sufficient.

What's new?

The contact address and identification markings must always be applied to the product itself. Application on the product packaging in exceptional cases only if labelling of the product itself is not possible. As soon as the product has other labels (e.g. embossing), the argument of technical difficulties does not apply. If a promotional item is sold without packaging, there is no alternative to labelling the product anyway. A switch to e.g. enclosed slips of paper is not permitted by law. A fixed connection to the product is required, which can consist of a fixed label or sticker.

Regardless of the requirements of the new product safety law, it remains important to know:

For some advertising novelties special regulations apply, which displace the defaults of the ProdSG. This applies in particular to toys and toy-related products, for which the requirements of the new EC Toy Directive 2009/48/EC have been applicable since 20 July 2011. This guideline contains much stricter requirements than the new ProdSG, which - in contrast to pure consumer products - now also apply in part directly to the trade.
